Malietoa title bestowment declared void

The three clans of the paramount title, Malietoa that represent the 52 sides in this months historic court case, will go back to the consultation process to select a successor to the title.

This follows the Lands and Titles Court decision delivered yesterday that declared void the bestowment of the Malietoa Title on Fa’amausili Moli last June.

The bestowment resulted in the court case with heirs of Malietoa Talavou and Malietoa Natuitasina charging that there was no proper consultation between the three clans to select a successor as of the Courts decision of 1939.

In delivering the Courts decision, Deputy President Tusani Tusani said the spirit of the Lands and Titles Court of 1939 that required consultation between the three clans was not fulfilled this time. Hence the bestowment of the title on Fa’amausili was declared void.

Fa’amausili was bestowed the title by the village of Malie last June, a few weeks after the passing of his father, the late 95 year old Head of State, Malietoa Tanumafili 11.

The bestowment was also questioned by the village of Afega who claim that the bestowment of the traditional salutation of the title – papa, is a duty that pertains to them.

A representative of the Malietoa Talavou clan, Papali’i Siliva Taouma hailed the Courts decision as just and timely and that the three clans need to go back for exhaustive consultation to select a successor to the title.

The heirs of Talavou and Natuitasina also claim that it is their turn to the title as the last two holders had been from the side of Malietoa Moli.
